Although your new lender may offer you an in-house lawyer, who will act on behalf of the new lender only, it is best for you to instruct your own conveyancing solicitor, so that you may retain control and speed up the remortgaging process. Using an independent solicitor can not only speed up the remortgaging process but ensures that you retain control of all relevant documents relating to the property (eg Building Warrants) that the new lender will not want to retain but are very important to produce when you come to sell the property some time in the future.
Remortgaging your home usually involves changing your mortgage lender so that your new mortgage pays off the old one. It is also possible to remain with the same lender, but change your mortgage package or raise a further advance on your loan.
During the process, your solicitor will examine your title deeds, ensure that everything is in order, and make a report to the new mortgage lender before requesting the new mortgage funds. It is important to note whose name(s) the title deed is in, and carry out the new mortgage in the same name(s) to avoid unnecessary costs and complications.
Your solicitor will be sent the loan paper from your new mortgage lender. He or she will also request your title deeds from your present mortgage lender. On receipt of the new mortgage papers and instructions, your solicitor will draw up and arrange the necessary documents, and payments.
